MyHomeTutor – Refund Policy (Malaysia)
Please read this policy carefully before subscribing to MyHomeTutor. This policy is governed by Malaysian Law, including the Consumer Protection Act 1999.
At MyHomeTutor, provided by BlackWire Consulting, we are dedicated to providing quality online educational services.
We aim to be transparent about our refund practices, which are framed within the context of Malaysian Consumer Law.
General Policy: Limited Refunds
While we strive for user satisfaction, to maintain affordable subscription fees and platform sustainability, MyHomeTutor operates on a limited refund basis.
Key Aspects of Our Refund Policy:
– Fees Generally Non-Refundable: Subscription fees and payments for MyHomeTutor are generally non-refundable except as explicitly stated in this policy or as mandated by applicable Malaysian law, including the Consumer Protection Act 1999.
– Service Provision Upon Payment: Upon successful payment, you gain immediate access to the MyHomeTutor platform and its services for the subscribed period. This constitutes the provision of service, and fees are primarily for this access and availability, not solely based on usage or outcome.
– No Refunds for Change of Mind or Dissatisfaction: We do not typically offer refunds for reasons such as change of mind, dissatisfaction with the platform’s features, tutor performance (within reasonable professional standards), or perceived lack of academic progress. We encourage you to explore any free trial periods (if offered) and utilize our support resources to address concerns before committing to a paid subscription.
– No Refunds for Non-Use or Partial Use: Refunds are not provided for non-utilization or partial utilization of the MyHomeTutor platform during your subscription period. It is your responsibility to engage with the platform during the subscription term.
– No Pro-Rated Refunds for Cancellation: If you choose to cancel your subscription, or if your access is terminated due to violation of our Terms of Service, no pro-rated refund will be provided for the remaining subscription period, unless mandated by Malaysian law.
Refunds Permitted Under Malaysian Consumer Law & Limited Company Discretion:
We acknowledge and adhere to the provisions of the Malaysian Consumer Protection Act 1999 and other relevant Malaysian legislation. Refunds may be considered in the following limited circumstances, subject to verification and at BlackWire Consulting’s assessment, or as legally mandated:
– Failure to Provide Service of Acceptable Quality (as defined under CPA): If MyHomeTutor demonstrably fails to provide services of “acceptable quality” as defined under the CPA, which includes considering factors like fitness for purpose, freedom from defects, safety, and durability, you may be entitled to remedies under the CPA, which could include a refund. This would typically apply to significant and persistent platform malfunctions or substantial breaches of our service commitments, not subjective dissatisfaction.
– Misrepresentation or Deceptive Conduct: If you subscribed to MyHomeTutor based on materially false or misleading representations made by BlackWire Consulting regarding the platform’s features or services, you may be entitled to remedies under the CPA, potentially including a refund.
– Non-Conformity with Contract: If the services provided by MyHomeTutor do not conform to the agreed terms of service or subscription agreement in a material way, and we are unable to rectify the issue, a refund may be considered, as per consumer rights.
– Billing Errors Directly Attributable to MyHomeTutor: In cases of demonstrable billing errors originating from MyHomeTutor’s systems (e.g., duplicate charges, incorrect amounts), we will rectify the error, which may include a refund of the overcharged amount.
– Prolonged and Unjustified Platform Outage: In the event of a significant and extended platform outage directly caused by MyHomeTutor that prevents access to services for a substantial portion of your subscription period, and which is not rectified within a reasonable timeframe, we may consider a pro-rata refund or subscription extension, depending on the circumstances and as deemed appropriate under Malaysian law.
Process for Refund Requests (If Applicable):
To request a refund under the limited circumstances outlined above, you must:
1. Contact our Support Team: Immediately contact our support team at [Your Support Email/Contact Method] detailing the specific issue and reason for your refund request. Please provide relevant evidence and documentation.
2. Provide Sufficient Information: You must provide all necessary information requested by our support team to assess your claim, including your subscription details, payment information, and details of the issue.
3. Assessment and Decision: BlackWire Consulting will investigate your request. Decisions regarding refunds are made on a case-by-case basis, considering the specifics of each situation, the terms of this policy, and relevant Malaysian law. Our decision will be communicated to you in writing.
